Terms of Service

1. Who we are

Fotobudi is operated by PEADIATREE LLP and provides AI-assisted tools that help online sellers create listing-ready product photos, short product videos, and related listing copy. For questions about the Service, billing, or these Terms, contact contact@fotobudi.com.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. If you use Fotobudi on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Accounts & security

• You must provide accurate account information and keep it updated.
• Authentication may be provided via third parties (e.g. Google). You are responsible for securing access to your linked accounts.
• You are responsible for all activity under your account.
• Notify us promptly at contact@fotobudi.com if you suspect unauthorized access.
• We may suspend or terminate accounts that violate these Terms, create risk of fraud, or abuse the Service.

4. The Service

Fotobudi provides digital tools that may include: AI product photo enhancement, custom backgrounds, short AI product videos, listing-copy helpers, credit balances, and related workspace features. We may modify, add, or discontinue features with reasonable notice where practicable. We do not guarantee uninterrupted availability.

5. Credits, pricing & payments

• The Service uses a credit system. Photo and video credits (and any other credit types we introduce) are purchased in packs and consumed when you run generations or eligible features.
• Prices, pack sizes, and what each credit covers are displayed on the Pricing page and/or at checkout. Prices may change; changes do not affect packs already purchased except as required by law.
• Payments are processed by third-party payment providers. Depending on your region and checkout method, a payment provider may act as merchant of record. Their terms may also apply to the payment transaction.
• Credits are non-transferable between accounts unless we expressly agree in writing.
• Refunds and cancellations are governed by our Refund & Cancellation Policy.
• Free or promotional credits (including signup bonuses) may be revoked or adjusted if we detect abuse, and are not redeemable for cash.

6. Acceptable use

You agree not to:

• Upload content you do not have rights to use
• Use the Service for illegal activity, fraud, scams, adult sexual content involving minors, harassment, hate, or other harmful purposes
• Generate or upload content that infringes intellectual property, privacy, or publicity rights of others
• Attempt to reverse engineer, scrape, overload, bypass rate limits, or disrupt the Service
• Resell access to the Service or credits without our written permission
• Misrepresent AI-generated images as unaltered photographs when that would violate marketplace rules or applicable law
• Use automated bots to create accounts or drain credits abusively

We may remove content, withhold outputs, deduct or cancel credits obtained through abuse, and suspend accounts that violate this section.

7. Your content & AI outputs

• You retain ownership of original product images and materials you upload, subject to the license below.
• You grant Fotobudi a worldwide, non-exclusive license to host, process, transmit, and display your uploads solely to operate and improve the Service (including sending images to AI subprocessors).
• AI outputs may be imperfect, inconsistent, or inaccurate. You are solely responsible for reviewing outputs before using them in storefronts, ads, or marketing.
• We do not guarantee marketplace approval, ranking, or sales outcomes on Amazon, Meesho, Flipkart, or any other platform.
• To the extent permitted by law, and subject to third-party AI provider terms, you may use generated outputs for your commercial listing purposes. You remain responsible for compliance with marketplace policies and advertising laws.

8. Intellectual property

The Fotobudi name, logos, software, UI, documentation, and site content are owned by Fotobudi or its licensors. You may not copy, modify, or distribute our software or branding except as needed to use the Service as intended.

9. Third-party services

The Service relies on third parties such as cloud hosting, authentication providers, analytics, payment processors, and AI model APIs. Their availability and policies affect the Service. We are not responsible for third-party outages beyond our reasonable control, but we will work to restore service and honour refund rights where credits fail due to our systems (see Refund Policy).

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS WILL BE ERROR-FREE OR MEET YOUR COMMERCIAL EXPECTATIONS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOTOBUDI AND ITS OPERATORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO FOTOBUDI FOR THE CREDITS GIVING RISE TO THE CLAIM IN THE THREE (3) MONTHS PRECEDING THE EVENT. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

12. Indemnity

You agree to indemnify and hold harmless Fotobudi from claims arising out of your uploads, your use of outputs, your violation of these Terms, or your infringement of third-party rights, except to the extent caused by our wilful misconduct.

13. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate access for Terms violations, fraud risk, non-payment, or to protect the Service. Provisions that by nature should survive (including IP, disclaimers, liability limits, and indemnity) survive termination.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date will change when we do. Continued use after changes constitutes acceptance of the updated Terms, except where local law requires additional consent. Material changes affecting paid customers will be communicated via the site or email where practicable.

15. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles, except where mandatory consumer laws in your country of residence require otherwise. Courts in India shall have jurisdiction, subject to those mandatory rights.
